PREAMBLE

These conditions of sale complete the preliminary description and establish the conditions of the activities related to the organization and sale of trips or stays by GARUDA SANE GALANG / GARUDAVENTURES www.garuda-adventures.com

They are brought to the attention of the Clients before any commitment on his part and complete the prior information referred to in the articles of the law No. 10 of 2009 on tourism in Indonesia, in addition to the descriptive sheets of the Services and, in certain cases, the Special Conditions of Payment and Cancellation in particular, specific to certain products and services. In the latter case, the Special Conditions indicated in the previous description of the product will prevail over the general text of these Special Conditions of Sale.

The prior information provided for in the articles of Law No. 10 of 2009 on Tourism in Indonesia may be modified after publication and consultation by travellers, in particular with regard to the main characteristics of travel services (in particular the conditions of transport and the course of the stay and accommodation), the price, the payment conditions, the minimum number of people possibly required for the trip, the conditions of cancellation by the client, in accordance

with the articles of Law No. 8 of 1999. The customer must be informed of this in a clear, comprehensible, and visible manner before the conclusion of the travel contract.

By confirming his contract, the traveller acknowledges having read these conditions as well as more precise descriptions of the services chosen. Failure to accept all or part of the conditions will result in the traveller waiving any use or benefit of the services provided by GARUDA SANE GALANG / GARUDAVENTURES.

1. Booking conditions

The traveller is considered to have the legal capacity to book a service, to be over 18 years old or emancipated and not to be under guardianship or curatorship. You provide, under your sole and entire responsibility, all the information necessary to create your client account and your order and declare that this information is sincere, accurate and up to date.
The traveller takes note of the information requested to create his profile and prepare his request, provides it as precisely as possible and under his responsibility.
The traveller receives a message acknowledging receipt of his request.
The traveller checks his quote, his order summary and the total price including tax and signs it with the words “Good for agreement”.
The traveller accepts the Special Conditions of Sale.
The traveller completes the registration form in its entirety.
The traveller pays the deposit and the balance by transfer to GARUDA SANE GALANG / GARUDAVENTURES
The traveller receives an email informing him that his reservation has been taken into account. In the absence of this letter, the reservation will not be taken into account. In accordance with Articles 46 to 49 of the Information and Electronic Transactions Act (ITE) No. 11 of 2008, the order and order confirmation will be considered received when the recipients can access them. In the event of incorrect contact details provided by the Clients, GARUDA SANE GALANG / GARUDAVENTURES is not responsible for the incorrect or non-receipt of the email.
The traveller will receive an email upon his return encouraging him to report the progress of his trip.

Registration is effective and validated upon receipt of the contract by GARUDA SANE GALANG / GARUDAVENTURES, accompanied by a deposit of 30% of the amount of the stay (for certain destinations, full payment may be requested for domestic flights at the time of booking) + the total amount of the additional insurance.

This deposit cannot be less than €100. The balance must be paid 40 days before the departure date, upon receipt of the invoice for the balance without reminder from GARUDA SANE GALANG / GARUDAVENTURES. For registrations less than 40 days before the departure date, all services are paid upon registration. GARUDA SANE GALANG / GARUDAVENTURES reserves the right to refuse a traveller

if the total price of the stay has not been paid in full 40 days before departure. In this case, the contract will be considered cancelled by the customer.

Payments must be made by bank transfer (money transfer fees in the country’s currency are the responsibility of the customer)

Confirmation of the travel contract implies, on the part of the client, acceptance and knowledge of these special conditions. The client expressly acknowledges having read, in the printed or electronic documents, the prior and descriptive information relating to the trips he has chosen.

Important: the client must wait for written confirmation of their reservation from a member of the GARUDA SANE GALANG / GARUDAVENTURES agency before making any commitment related to the booked trip: flight reservations, train reservations, nights before or after the trip, etc. Failing this, the client assumes responsibility for the costs incurred before the validation of their reservation.

2. Prices

The prices indicated are expressed in euros, taxes included, and are updated periodically according to changes in itineraries, exchange rate variations and service prices.

The final price of your trip will be confirmed when you book. Prices are calculated in number of nights based on shared double rooms.

In the description of each stay, the services included and not included are mentioned, as well as the amounts of supplements, if applicable, for single rooms, higher category services or small groups.

Prices never include: flight, visa fees, money transfer fees in the country’s currency, tips, personal expenses, supplement for changing the number of participants and single room and in general anything that is not included: it is not mentioned in the contract.

Price revision

GARUDA SANE GALANG / GARUDAVENTURES expressly reserves the right to modify its prices upwards or downwards to take into account in particular variations in the cost of transport, taxes and fees on travel services such as tourist taxes, landing or embarkation and disembarkation fees in ports and airports or exchange rates in relation to the chosen trip. The contract will mention the methods for calculating the price revision and the part of the price concerned.

In the event of an increase in the sale price, regardless of its importance, the information will be transmitted to the traveller in a clear and comprehensible manner with supporting documents and calculation, on a durable medium, no later than 20 days before the start of the stay.

In accordance with the articles of Laws No. 8 of 199, No. 10 of 2009 and Ministerial Regulation No. 33 of 2016, when the increase in the price of the package reaches at least 8%, GARUDA SANE GALANG / GARUDAVENTURES will inform the customer accordingly, in a clear, comprehensible and obvious manner on a durable medium, the increase, the reasonable period to express his acceptance or refusal with termination of the contract and free refund within 14 days and the consequences of his lack of response (application of the resolution of costs).

3. Liability

GARUDA SANE GALANG / GARUDAVENTURES will provide the necessary assistance to the traveller in difficulty but is not responsible for the consequences, nor can it financially replace the traveller, if the following events occur:

Failure to present and/or loss or presentation, at the police station, customs or registration, of expired identity and/or health documents or those with an insufficient period of validity, poor condition of identity documents (validity date of the passport of at least 6 months, minimum 2 blank pages in the passport to affix visas) essential to leave the country visited and return to France.
Costs generated by the loss of transport tickets by the traveler (costs and penalties for reissuing tickets and costs incurred in particular in the event of immobilization in the country).
Debt incurred by the traveller with a third party (extras in hotels, etc.)

GARUDA SANE GALANG / GARUDAVENTURES is fully responsible for the proper execution of the obligations resulting from the travel contract within the meaning of the articles of the Indonesian Tourism Law No. 10 of 2009. The traveller is informed that under no circumstances will GARUDA SANE GALANG / GARUDAVENTURES be liable when the damage is attributable either to the traveller or to a third party not involved in the provision of travel services and is of an unforeseeable or unavoidable nature, or to exceptional and unavoidable circumstances (war, attack, riots, revolution, nuclear disaster, climatic or geological events).

In the event of the application of the automatic liability of GARUDA SANE GALANG / GARUDADVENTURES towards its service providers within the meaning of the mentioned article, the compensation ceilings provided for in the articles of laws No. 8 of 199, No. 10 of 2009 and Ministerial Regulation No. 33 of 2016, in particular when international agreements apply that limit the compensation owed by these service providers. In other cases, the contract may limit any damages to three times the total price of the trip (except for personal injury and intentional or negligent faults).

It may happen, for reasons of duration, attendance or decisions of the hoteliers on site, that there is an insufficient number of equipment in the places of stay or that certain activities are suspended.

GARUDA SANE GALANG / GARUDAVENTURES will not be held responsible in any way in the event that an incident occurs during services purchased outside of the contract and directly on site by the traveller from an external service provider or resulting from a personal initiative of the traveller.

4. Administrative and health procedures

For each destination, the traveller receives information relating to the country and its procedures, which are updated via the website of the Ministry of Foreign Affairs. However, given the sometimes rapid evolution of the political situation in a country, it is up to each traveller to inform themselves personally.

French nationals can consult the police, customs and health formalities of the country of destination and the country(ies) of transit on www.diplomatie.gouv.fr or on www.actionvisas.com and health on www.travelsante.com .

Spanish nationals can consult the police, customs and health procedures of the country of destination and the country(ies) of transit on https://www.exteriores.gob.es . Other nationalities must consult the consulate of the country of destination and the country(ies) concerned.

5. Cancellations/Modifications

5.1. Changes Modification fees

Any modification to the contract, once validated by the buyer, after registration, will be subject to a modification fee of €80.

5.2. Cancellation by the traveller

According to the articles of the Indonesian Tourism Law No. 10 of 2009, the traveller may terminate (cancel) his contract at any time or modify it (any modification less than 60 days before departure is considered a cancellation), by means of a registered letter with acknowledgment of receipt. The date of signature of the acknowledgment of receipt will be authentic.

Unless special conditions mentioned in the quote and in the contract, the amount of the sums withheld from the refund is calculated according to the following scale:

For land:

Up to 61 days before departure: 10% of the price of ground services.
From 60 to 30 days before departure: 30% of the price of ground services.
Less than 30 days before departure: 100% of the price of ground services.
For any cancellation between the day of booking and up to 61 days before departure: 50% of service cancellation fees
For any cancellation between 60 days and 31 days before departure: 75% of service cancellation fees
For any cancellation less than 31 days before departure: 100% of service cancellation fees

For air travel (domestic flights), unless otherwise indicated when booking, cancellation between confirmation of the file and departure will result in fees corresponding to 100% of the price of the confirmed services.

Interruption of stay:

Any trip interrupted or shortened by a participant for any reason whatsoever will not give rise to any refund.

5.3. Cancellation by SANE GALANG / GARUDAVENTURES

If GARUDA SANE GALANG / GARUDAVENTURES must cancel a departure for any reason whatsoever, persons already registered will be fully reimbursed and may receive additional

compensation at least equal to the penalty they would have incurred if the cancellation had occurred on their part.

On the other hand, GARUDA SANE GALANG / GARUDAVENTURES may cancel the trip without additional compensation if:

There is not a sufficient number of participants registered for the departure. GARUDA SANE GALANG / GARUDAVENTURES will then inform the customer:
20 days before the start of the trip whose duration exceeds 6 days
7 days before the trip whose duration is 2 to 6 days
48 hours for trips not exceeding 2 days.

However, the trip may be maintained if each participant accepts a modification of the contract with a price adjustment, calculated as accurately as possible and not exceeding 10% of the price of the stay. The minimum number of participants as well as the flat-rate supplement for small groups are indicated on the product sheet. Failing this, another date or another destination will be offered to you, without any obligation to contract.

When exceptional and unavoidable circumstances arise that prevent the execution of the contract.

In this case or if a significant part of the services cannot be provided or when non-compliance significantly disrupts the trip and if this is possible for GARUDA SANE GALANG / GARUDAVENTURES, services of equal or higher quality will be offered at no extra cost.

In certain circumstances, particularly due to weather conditions, the tour, accommodation, transport and walks may be modified. The traveller cannot refuse the modification without a valid reason, particularly if the services offered are not comparable. Each time, we do everything possible to ensure that you can carry out your programme by offering you alternatives: another location, another route, another activity, another date, etc.

6. Transfers

In the case of group trips, transport to the group meeting point remains the responsibility of the traveller, unless otherwise indicated in the quote.

For tailor-made trips (excluding group tours), transfers are included in the budget.

7. Remarks

Each participant is aware of the sporting nature of certain GARUDA SANE GALANG / GARUDAVENTURES trips and the possible distance from medical centres. You consciously assume the risks and undertake not to hold GARUDA SANE GALANG / GARUDAVENTURES or the accompanying persons or the various service providers responsible for any accidents that may occur. This also applies to beneficiaries and any family members.
The diving levels and personal items (height, weight, etc.) communicated during registration are contractual elements provided under the responsibility of the traveller: the service provider on site reserves the right to refuse any diver whose level or skills are different from those validated at the time of the contract and this would be incompatible with the smooth running of the immersion. In this case, the client will not be able to claim any compensation since the noncompliance would be attributable to him.
Any trip shortened; any service not used by the traveller will not give rise to any reimbursement.
GARUDA SANE GALANG / GARUDAVENTURES reserves the right, unless otherwise indicated in writing by the traveller when formalizing their contract, to use photographs or films taken during the trip to illustrate certain programs on their websites, brochures or social networks, without this giving rise to compensation or indemnification.

8. Insurance

No insurance is included in the prices offered by SANE GALANG / GARUDAVENTURES. The traveller is required to take out insurance at the time of booking to cover the consequences of certain cancellations and an assistance contract that also covers repatriation in the event of an accident or illness.

GARUDA SANE GALANG / GARUDAVENTURES recommends carefully reviewing the guarantees taken out and having emergency telephone numbers.

9. Contract transfer

The traveller may transfer his contract to a third party and must inform GARUDA SANE GALANG / GARUDAVENTURES by any means allowing acknowledgement of receipt as soon as possible and at most 7 days before the start date of the trip, indicating precisely the name and address of the transferee and the participant in the trip, justifying that the latter meets the same conditions as him to carry out the stay or the trip.

The transferor or transferee will be jointly and severally liable for the payment of any balance of the price as well as the corresponding costs incurred by this transfer.

However, when it comes to domestic air services, the transfer of the contract to a third party cannot be made.

The traveller cannot assign his/her insurance contract(s).

10. Complaints, disputes

The traveller must inform the on-site team of any non-conformity noted. Otherwise, you run the risk that your claim for compensation will not be satisfied.

Any possible claim or dispute related to the smooth running of the trip that cannot be resolved directly on site must be notified and justified within one month from the date of return from the trip, by registered letter with acknowledgment of receipt. Supporting documents or a written report from the local service provider must support the claim. GARUDA SANE GALANG / GARUDAVENTURES will process the file as soon as possible, taking the time to conduct an investigation with the service providers. 11. Protection of personal data

Please note that the personal data requested from the Customer are necessary for processing your order and issuing invoices, in particular.

This data may be communicated to all of the Company’s partners responsible for the execution, processing, management and payment of orders.

The information collected by GARUDA SANE GALANG / GARUDAVENTURES is subject to computer processing aimed at better responding to requests. The processing of this personal data is carried out in accordance with the Indonesian Personal Data Protection Act No. 27 of 2022 (Undang-Undang Perlindungan Data Pribadi, or UUPDP). This data is intended for the company SANE GALANG / GARUDAVENTURES and its partners and may be transferred to third parties as part of the execution, processing, management, and payment of orders.

Each traveller has at any time a permanent and free right of access and rectification, deletion, or opposition to their personal data. 12. Intellectual property

The content of the website and applications is the property of GARUDA SANE GALANG / GARUDAVENTURES and is protected by laws n ° 28 of 2014 on copyright and n ° 15 of 2001 on trademarks, relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and could constitute an offense of falsification.

Furthermore, GARUDA SANE GALANG / GARUDAVENTURES remains the owner of all intellectual property rights on the photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the request of the traveller). The traveller therefore prohibits any reproduction or exploitation of said studies, drawings, models, and prototypes, etc., without the express, written, and prior authorization of GARUDA SANE GALANG / GARUDAVENTURES, which may make it conditional on financial compensation.
